Leave & Attendance Policy

Effective Date: April 21, 2026 · Jurisdiction: Ghaziabad, Uttar Pradesh (UP)

1. Classification of Personnel

  • Trainees / Interns: Individuals undergoing a fixed-term learning program. They are not considered permanent "workmen" under the standard labor definition for the purpose of paid leave.
  • Permanent Employees: Individuals who have successfully completed their probation period and received a formal Letter of Confirmation.

2. Leave Policy for Trainees

Shuchit Infotek operates as a high-performance learning environment.

  • Zero Paid Leave: Trainees are not entitled to any paid leave (EL, SL, or CL) during their training period.
  • Leave Without Pay (LWP): Any absence from the workplace will be strictly treated as Leave Without Pay. The stipend/remuneration for that month will be deducted on a pro-rata basis.
  • Impact on Completion: Excessive absences (more than 2 days a month) may lead to an extension of the training period or termination of the internship/traineeship at the discretion of the Management.

3. Leave Policy for Permanent Employees

In compliance with the Uttar Pradesh Shops and Commercial Establishments Act, permanent employees are entitled to the following:

A. Earned Leave (EL) / Privilege Leave

  • Entitlement: 15 days per year, accrued after 12 months of continuous service.
  • Accrual: 1 day for every 20 days worked.
  • Carry Forward: Up to 45 days. Any excess will be encashed at the end of the calendar year.

B. Sickness Leave (SL)

  • Entitlement: 15 days per year (Available after 6 months of service).
  • Medical Certificate: Mandatory for any sickness leave exceeding 2 consecutive days.

C. Casual Leave (CL)

  • Entitlement: 10 days per year.
  • Usage: For unforeseen personal matters. CL cannot be carried forward to the next year and cannot be encashed.

4. The "Sandwich Rule" (Critical Clause)

To maintain operational continuity and prevent misuse of long weekends, Shuchit Infotek follows a strict "Clubbing" policy:

  • Holiday Inclusion: If a leave (EL, SL, or CL) is taken immediately before, after, or both surrounding a Weekly Off (Sunday) or a Public Holiday, that Weekly Off/Holiday will be counted as part of the leave.
  • Example: If an employee takes leave on Friday and the following Saturday is a Weekly Off, the total leave deducted will be 2 days (Friday and Saturday).
  • Example: If an employee is on leave on Monday and the preceding Sunday was a Weekly Off, both Sunday and Monday will be deducted as leaves.

5. Application & Approval Process

  • Notice Period: Except for medical emergencies, all leave applications must be submitted via the official management system at least 3 working days in advance.
  • Management Discretion: Leave is not a matter of right. Approval is subject to project deadlines and operational requirements at Shuchit Infotek.
  • Unapproved Absence: Any absence without prior written approval will be marked as "Absent" and treated as Unpaid Leave, regardless of the employee's leave balance. This may also trigger disciplinary action.

6. Termination & Resignation

  • Notice Period Leaves: Employees are generally not permitted to take Earned Leave during their notice period.
  • Encashment: Upon legal termination or resignation, only the accumulated Earned Leave (up to 45 days) will be settled as per the last drawn basic salary. CL and SL are not encashable.

7. Compliance & Discipline

Shuchit Infotek maintains a zero-tolerance policy for "Leave Fraud" (providing false reasons for absence). Misrepresentation will lead to immediate disciplinary proceedings as per the labor directives of Uttar Pradesh.
